Rules and Regulations of Wildewood Springs IIA Condominium Assn., Inc.
Welcome to Wildewood Springs IIA.
Living in a condominium can be a happy and rewarding experience. The following rules and regulations are for the purpose of protecting Association property and making condominium living a pleasant experience. Your cooperation is essential in order to accomplish these purposes. Common sense and consideration for your neighbors is the key to its success. Please familiarize yourself with the Declaration of Condominium document, Articles of Incorporation, By-Laws, and the following Rules and Regulations.
Rules and Regulations as amended January 17, 2012
The following Rules & Regulations are in conformance with the State of Florida’s statutes relating to condominium properties. All unit owners and occupants shall be governed by and comply with the terms of the Declaration of Condominium, Articles of Incorporations, By-Laws, and the following Rules & Regulations.
I. Compliance, Occupancy & Use
1. Failure of unit owners and occupants to comply will subject a unit owner to penalties and legal action as determined by the Board of Directors.
2. Units shall be used by owners, their families, guests, and by renters who have been approved by the Association.
3. Units shall be used only for residential purposes.
4. Owners are responsible for anyone occupying their unit who violate the Association’s Rules & Regulations.
5. No nuisances are permitted, and no immoral, offensive or unlawful use, shall be made of any part of the property.
6. No unit owner or occupant may display any sign, which is visible from the exterior of the unit, or any sign in any automobile, which is visible from the outside. This rule prohibits any “For Sale” or “For Rent” or other advertising sign being placed anywhere on WWS IIA property.
7. The parking and carport areas are not to be used as a playground. Skateboards, small tricycles, wagons, roller skates, roller blades and other similar equipment are not permitted on area streets, sidewalks, carport, or parking areas. Camping is not permitted on Association property.
8. Bicycles are not to be placed in carport areas without prior approval by Board of Directors. Subject to such approval, bicycles should be securely chained to a carport stanchion when not in use. Bicycles may be placed within units or within enclosed garden areas and courtyards.
9. Radios, stereo sound equipment, televisions, musical instruments or other sound-making electronic devices should be played at a reasonable volume so as not to annoy other residents.
10. Estate sales, auctions, yard sales, and flea markets or related uses of condominium property are not permitted at any time on any area of common or limited common property.
11. Any family member or guest occupying a unit in WWS IIA in the owner’s absence must be registered by the owner prior to such occupancy. The owner must notify the management company, giving the date of arrival, length of stay, number of persons, and relation to the owner.
12. Boats and flotation devices are not permitted on Association property. Residents may fish for sport from the shores of condominium lakes but ‘catches’ must be returned to the lakes.
13. Laundry, clothing, swimsuits, towels, beach items and similar objects may not be stored or hung on the outside of units. No other item which, in the opinion of the Board, is unsightly may be displayed so as to be visible on the exterior of a unit.
14. Solicitations are not permitted on Association property.
15. No firearm may be discharged on Association property (does not apply to law enforcement officers and licensed security guards).
16. Fireworks are not permitted on Association property.
17. Lawns, shrubbery and other established plantings in the common area may not be added to, altered, or removed by unit owners or occupants without the written approval of the Grounds Committee. Planting request forms are available from the management company.
18. Fenced-in courtyards at the front of each unit and walled courtyards are to be tended by the owner. All other areas are cared for by the landscape contractor. Spaces below staircases are not to be used for storage or placement of any materials other than shrubs and plants. Yard waste including plants, clippings, and garden debris must be disposed of in designated bins in the dumpster area. Waste Management does not accept this material in the dumpster.
II. Rentals & Sales
1. No unit shall be purchased or leased unless approval by the
Association is obtained prior to occupancy.
2. All leases (tenancies) must be for a minimum of three months. At least 10 days prior to occupancy by a tenant, owners must submit a written application to the Board or to its designated representative together with the Association fee of $100. Subsequent renewals of leases by the same tenant are not subject to the application or fee.
3. Units shall not be rented or leased for a period of 24 months following the purchase or acquisition of the unit. The date of acquisition shall be established by the date of the recoding of the deed.
4. No unit shall be sublet by a Lessee.
5. Unit owners or their representatives shall provide their Purchasers or Lessees with a copy of the Association Rules & Regulations. Each application to purchase or lease shall include the Purchaser’s or Lessee’s agreement to comply fully with these Rules & Regulations.
6. No unit shall be sold without 10 day’s prior application to the Board or its designate, together with the Association fee of $100, and the granting of approval to the application. 7. Prospective owners and lessees are to be interviewed by a Board Member or designated representative prior to sales or lease approval.
III. Alterations, Repairs & Safety Precautions
1. Unit owners and tenants may not make any alterations to the exterior of buildings without the approval of the Board of Directors.
2. Unit owners and tenants may not make any structural alterations to load-bearing walls or partitions within their units without the written approval of the Board of Directors. The Board will take into consideration any effects on neighboring units.
3. Exterior hurricane shutters shall be aluminum, accordion-type shutters in an off-white color. Request forms can be obtained from the management company.
4. An Architectural Change Request form for the alteration requests above can be obtained from the management company.
5. Any work performed to an Owners AC system on the rooftop of the building that causes damage to the roofing system will be assessed to the Owner. Owners should notify the Board of Directors in writing before new AC equipment is installed on the roof.
6. Unit owners who fail to make reasonably required repairs after receiving notice from the Association to do so shall be assessed by the Board for the cost of such repairs which the Board may cause to be done.
7. The Building Committee directs the work of the maintenance staff. Residents should not contact maintenance staff directly. Requests for work on community or individual property must be made to the Building Committee or the management company.
8. It shall be unlawful for any person to use, or operate within any building or structure located within the jurisdiction of Cedar Hammock Fire Control District:
a. Any charcoal, gas or propane cylinders or wood fired heaters, grills, barbecues on balconies, porches or breezeways of multi-unit, multi-story buildings;
b. Any unvented fuel oil or kerosene burning appliance, including those with a woven wick, designed for heating purposes; and
c. Any other heat producing device or appliance, which is determined by the Authority Having Jurisdiction to be unsafe due to its application or use.
9. For safety reasons and egress purposes, no object of any kind may be stored on stairs, railings, or decks leading to second-floor units, which may interfere with egress or Fire Department operations.
10. Failure to abide by these regulations could result in the loss of the
Association’s condominium insurance and the loss of individual insurance, as well as a fine by the Manatee Fire Code Enforcement Board, as established by Chapter 85-461, F.S. of up to $250 a day for each day of the violation constituting a separate offense.
IV. Recycling & Treatment of Garbage & Trash
1. Recycling is mandatory in Manatee County. Each cluster is provided with a dumpster for household trash and recycling bins for paper, glass, plastic, and cans. Please dispose of items according to the recycling signs.
2. All dumpster garbage must be disposed of in tied or sealed bags. Cartons must be broken down and flattened to conserve space. Do not put microwave ovens, TVs, or other electronic items in the dumpster. Carpeting, tiles, flooring, or other construction material should not be placed in the dumpster. Contact Manatee County for further information regarding large items and hazardous waste.
3. County law requires yard debris to be kept separate from all other trash. Bins for yard waste, plant clippings, and dirt are provided at this location. Please do not dispose of extremely large plantings in this area. Yard waste IS NOT allowed in the dumpster or recycling bins.
4. Do not leave any material such as furniture, mattresses, electronic equipment, etc. outside the dumpster. It will not be taken away. Contact Manatee County for further information
V. Traffic, Vehicles, and Parking
A van with solid panel sides is classified as a truck. A van with side windows and seats behind the driver is classified with autos. A vehicle with a cutaway cargo deck is classified as a pickup truck.
1. The speed limit is 15 miles per hour and must be observed. This limit is intended to ensure the safety of pedestrians and cyclists as well as other motorists. Come to a complete stop at stop signs and check oncoming traffic before proceeding.
2. Pedestrians have the right of way. Please allow residents to walk and run in WWS freely and without harm. Walkers should always walk on the side of the road facing oncoming traffic and are advised to carry a flashlight and wear reflective clothing after dark.
3. Only Autos (Sedans), Passenger Vans, Mini-Vans, and SUV’s are considered appropriate for parking on Association property. Acceptable vehicles are to be parked so as not to obstruct walkways. Trucks and motorcycles are not allowed.
4. Residents of each unit are permitted to park not more than two vehicles per unit on Association property, including assigned carport spaces. Additional vehicles may be parked by guests and visitors for up to two weeks at a time, in the guest parking locations only.
5. Although WWS-IIA does not have assigned parking spaces, it is appropriate and courteous that the space directly in front of a unit is viewed as that owner’s space. Any second vehicle should be parked away from the unit. Owners should park in their carports whenever possible.
6. Washing or repairing of vehicles on Association property is prohibited.
7. Carports are for the exclusive use of the appropriate owners or their designees.
8. Owners are responsible for the clean-up of vehicle oil and other fluid leaks and spills. If such spills cause damage, the Board reserves the right to repair any such damage and bill the responsible owner.
9. Vehicles that are inoperative, not currently licensed, or which, in the opinion of the Board, are unsightly, may not be parked on
Association property.
10. Commercial vehicles may not be parked on Association property except when being used to provide service to units and residents.
11. In special instances such as a resident moving in (or out) that entails the parking of an otherwise prohibited vehicle overnight, permission may be obtained from a member of the Board for limited overnight parking. Prohibited vehicles parked overnight without permission will be towed away at the owner’s expense.
12. Trailers, mobile homes, campers, golf carts, mopeds, motorcycles, pickups, commercial vans and trucks of any kind, may not be parked on Association property overnight. Without the special permission stated above, vehicles parked in violation of these rules will be towed away at the owners’ expense.
VI. Pets
1. One dog (not weighing more than 25 pounds when fully grown) or one cat is allowed per unit.
2. Wild birds and squirrels are not viewed as pets. They should not be fed. Heron, ibis, as well as smaller species can become destructive if such feeding is later stopped.
3. All pets must be leashed at all times when outdoors on Association property. Cats, in particular, are not to be allowed to roam the grounds, unleashed, day or night.
4. Vicious, noisy, or other unpleasant pets are not allowed. Determination of such annoyances shall be made at the sole discretion of the Board.
5. Scoop and bag all messes. Do not dispose of pet feces on Association grounds.
VII. Pest Control
1. It is required that every unit be treated to ensure that all units are free of vermin and insects. Each unit owner or tenant must provide the Association with a key or be at home at the date and time scheduled and posted on bulletin boards. If an owner or tenant is planning to be away on a scheduled date, a key should be left with a neighbor to provide access to the unit.
2. If access to a unit is not provided on the scheduled date of treatment, the pest control company will be called back for an additional visit. In such a case, the owner of the unit will be charged for the service.
VIII. Pools
1. Pool occupancy is limited to 15. Spas are limited to 7.
2. ID tags must be displayed at all times.
3. Pool showers must be used before entering the pools. No soap or detergent is to be used in the showers.
4. Suntan lotions and oils must be removed before entering pools. Repeated applications of lotions and oils must also be removed.
5. Food and glass containers are not allowed in the pool area. Liquid refreshments are allowed in plastic or paper containers.
6. Children under 12 years of age are not permitted in pools without adult supervision.
7. For safety reasons, diving and jumping into the pools, as well as running and “horseplay” in the pool areas is prohibited. Beach balls, floats, or toys in or around the pools are not allowed.
8. Children are not permitted in the spas. Infants in diapers, or requiring diapers, are not permitted in the pools at any time.
9. No pets may be brought into the pool area at any time.
10. All personal property must be removed when leaving pool areas.
11. Using the pools is at one’s own risk. No lifeguard is on duty at any time.
12. Cell phones must be used outside the fenced area only. Radios and other audio equipment may only be used with earphones. Exceptions may be made for community activities and events.
13. Pools and spas are closed from 11:00 PM to 6:00 AM.
XI. Tennis Courts
1. Only regulation, white-soled tennis shoes are permitted on the courts. Shirts must be worn.
2. When all the courts are filled, players are limited to one hour for singles and one-and-a-half-hours for doubles play.
3. Tennis courts are for tennis only. No basketball, skating, walking et cetera.
4. Playing of radios or musical instruments is prohibited.
5. Owners and tenants are limited to three guests at one time for doubles play.
6. Tension on posts must not be increased. Center straps are at three feet, as regulated by international tennis rules.
7. Non-residents or visitors, even though related to an owner, may not use courts except when playing with a resident.
8. Gate must be padlocked at all times when courts are not in use.
9. A unit owner or lessee is entitled to one key per unit by seeing the Board President of Wildewood Springs IIB. There will be a charge of $100 for an additional key if this key is lost or misplaced. Keys are not to be duplicated or loaned to others. Unlocking courts for others is prohibited.
X. Miscellaneous
1. Outdoor Furniture - Outdoor furniture must be taken in at night unless it is within a walled or fenced courtyard.
2. Water Heaters - It is very important that every owner check the date of installation on the unit water heater. If the life expectancy of the water heater has expired, it must be replaced with a new unit. This is especially true of second floor units. If the water heater leaks, it will deposit a very large amount of water not only in the upstairs unit but also in the unit below. This damage is NOT covered by the Association’s insurance. This is a unit owner’s expense, which may or may not be covered by the homeowner’s insurance.
3. When Owners Are Away - It is imperative that owners provide for the safety and maintenance of the unit when not in residence. Events such as storms, leaks, broken windows, non-functioning AC units, break-ins, and mold can damage or destroy not only the owners’ property but also that of its neighbors. The Association strongly recommends that each unit owner arrange to have the unit checked weekly either by an individual or a contracted service. Neighbors and friends are sometimes willing to check units, and there are many resources for contracted services at reasonable rates. Please contact a Board member or management for recommendations.

( ) Have your A/C serviced prior to departure. Set thermostat to 80˚ and humidistat to 60-65. Refrigerators:
( ) If you leave your refrigerator on, turn off the ice maker and empty ice. Remove perishable food from refrigerator and all meats from freezer. Place water jugs ¾ full in the freezer to cut down on energy use.
( ) If you turn off your refrigerator, unplug it and prop open the doors. Empty the ice container.
Electrical:
( ) Turn off power to the stove and the hot water heater. (When you return, run the water in one of the sinks for several minutes to clear out stagnant water).
( ) Unplug TVs and electronic equipment.
( ) Unplug the microwave and other small appliances around the home.
( ) Turn off ceiling fans.
Plumbing:
( ) Leave toilets with ½ cup of bleach in bowl and cover bowl with plastic wrap, overlapping to stop water evaporation. Place a heavy object on the closed lid. Turn off water valve behind the toilet bowls.
( ) Close all drains in sinks and tubs.
( ) Turn off washer valves.
General:
( ) Send temporary change of address to Post Office.
( ) Arrange for a house watcher and give him/her a key.
( ) Stop newspaper delivery and notify magazines of address change.
( ) Give management company summer schedule and mailing address. Be sure management has a key.
( ) Notify Social Security (if applicable) of address change. This can be done online.
( ) Lock all windows and sliding glass doors and close shades/drapes.
( ) Bring all outdoor furniture inside.
( ) Shut off the outside main water inlet valve.
( ) Lock the front door!
Following the Rules
Sometimes rules seem to be arbitrary . . . better to be ignored.
But to preserve the standards and beauty of Wildewood Springs IIA as they have existed for many years, adherence to the rules is important for all. Enforcement of these rules will consist first of a written notice. If not corrected in a timely manner, action will be taken as set forth in state statutes and these Rules & Regulations, including reasonable fines as determined by the Board of Directors.
